BOSE SAUNA, BOSE SAUNA & HYDRO SPA trading name” means ORE AUSTRALIA PTY LTD General Agreement: “Client” means the person(s) purchasing the Goods or Services, and if there is more than one client, is a reference to each client jointly and severally, including any agent or customer. “Goods” means any goods supplied by BOSE SAUNA. “Guarantor” means that person or persons or entity who agrees to be liable for the debts of the Client or purchaser on a principal debtor basis. “Price” means the price payable for the Goods and Services as agreed between BOSE SAUNA and the Client under these Terms. “Quotation” means a quote for Goods and or Services provided by BOSE SAUNA to the Client, any product or service provided or sold to the client. “Service” means all Services provided by BOSE SAUNA to the Client and includes any advice or recommendations, and where the context so permits, shall include any supply of Goods as defined above. “Warehousing Fee” means there is no charge for warehousing for a maximum of 30 days. The client must take full delivery of all goods ordered and provide full payment to BOSE SAUNA within and maximum of 30 days, unless otherwise agreed by BOSE SAUNA in writing; otherwise, a warehousing fee market rate will be applied as nominated by BOSE SAUNA.

  • 1.1. These terms and conditions of trade (“Terms”) of BOSE SAUNA apply to all supplies of all Goods and Services by BOSE SAUNA to the Client. 1.2. By ordering Goods or Services from BOSE SAUNA, the Client accepts these Terms without limitation. 1.3. The Client is bound by any amendments that are made to the Terms. 1.4. To the extent of any inconsistency between these Terms and any terms sought to be imposed by a Client without the written consent of BOSE SAUNA, then these Terms shall prevail. 1.5. Where more than one Client has entered into contact or agreed with BOSE SAUNA, then the acceptance by one Client shall mean that all Clients are jointly and severally liable for all payments due and owing. 1.6. If any provisions of these Terms are inconsistent with the PPSA, the PPSA shall prevail to the extent of that inconsistency. 1.7. These Terms and any contract to which they apply shall be governed by the laws of Victoria. 1.8. BOSE SAUNA may license or subcontract all or part of its rights and obligations without the Client’s consent. 1.9. Any client disputes regarding warehousing fees, tax invoice/s sent by BOSE SAUNA for goods delivered or to be delivered to the client, the client must contact BOSE SAUNA accounts office strictly within 5 working days from BOSE SAUNA email sent to client and or tax invoice/s send to client to correct any unforeseen mistakes/ errors to the tax invoice/s to correct the amount invoiced.
  • 2.0. BOSE SAUNA will not take any responsibility for any discrepancy that might have been agreed verbally or in writing, and or if the product/s have been installed after 5 working days for invoice/s sent to the client.
  • 2.1. All client purchase order variations must be emailed to BOSE SAUNA and approved by our office. By placing an order and/or making a deposit, you, the customer, agree to these terms, which supersede any other agreements. If you disagree with any part of these Terms and Conditions, please do not use our site or services.
  • 2.2. Ordering and Cancellations: BOSE SAUNA will provide the Client with a Quote for Goods and Services. Quotation is valid for 30 days or as nominated in the quotation. It is subject to the fluctuation of all trading currencies, including $AUD and any other currency of trade, and subject to any shipping cost change, changes to manufacturing cost and any variations. 2.3. BOSE SAUNA reserves the right to change the Quote if the Client’s instructions change. 2.4. All client purchase orders must provide the following information at the time of ordering goods & services other than stocked items – products: a. Verbal orders by the client are also deemed as an order. The client must then, on the same day, email all verbal order information to BOSE SAUNA to confirm the order. BOSE SAUNA is strictly not liable for any errors in the supply or installation of goods & services – products that the client verbally orders from BOSE SAUNA. b. The client must provide a minimum of 50% deposit of the invoice, including GST, for the order to be processed, and full payment is required before delivery. c. The client must accept delivery of all products ordered, including custom-made special orders, within 30 days from the available date of delivery to the site provided by the client to BOSE SAUNA. d. All custom-made orders must be paid in full within 5 working days by the client to BOSE SAUNA upon the shipment arriving at the Melbourne warehouse. e. Any deposits of money given by the client to BOSE SAUNA to hold stock of a product that is warehoused in Melbourne or any warehouse in Australia to purchase goods, the cancellation fee is a minimum of 20% of the tax invoice, including GST. The client must accept delivery of the order within a maximum period of 30 days from receipt of the deposit. The order can only be cancelled with BOSE SAUNA office approval in writing. After the 30 days have expired, the client must pay for the full amount of the tax invoice provided; no refund is provided by BOSE SAUNA to the client after 30 days. Delivery of the ordered goods must be accepted by the client within 30 days. f. Transport delivery of goods to the client address is subject to the availability of transport on the date required, and is subject to availability based on the delivery postcode. We can confirm by email with the customer if we can deliver to your postcode before making payment for placing your purchase order. Transport rates vary depending on the size of the pallet and the distance from the warehouse to the site address. The delivery cost can be calculated and provided by our office to the customer. 2.5. BOSE SAUNA may cancel any client contract order or the delivery of the order to which these Terms apply, at any time by giving written notice to the Client. 2.6. If BOSE SAUNA cancels an order or contract, the Client agrees that BOSE SAUNA will not be liable for any loss or damage that may be suffered by the Client. 2.7. The Client assumes all responsibility for ordering the correct material, size, and finish, and BOSE SAUNA shall in no way be held liable for any loss or damage the Client may suffer due to having ordered an incorrect quantity or type of Goods. 2.8. Supply of Goods is subject to availability at the time an order is placed and or a deposit payment received. 2.9. Cancellation fee: means a minimum of 20% cancellation re-warehousing fee of the total tax invoice, including GST of the Goods and Services in the purchase order provided by the client, and or tax invoice issued by BOSE SAUNA, plus transport fees. All orders warehoused by BOSE SAUNA for the client for over 30 days must be paid in full by the client; a warehousing fee applies for orders warehoused for more than 30 days. All orders placed by the client cannot be cancelled after 30 days from receipt of the purchase order and or deposit received. This specifically relates to products stocked and warehoused in Melbourne or any part of Australia by BOSE SAUNA. Note: Custom-made orders, or client orders that need to be manufactured and imported, cannot be cancelled at any time after BOSE SAUNA receives the order and or deposit paid by the client.
  • 3.0. Availability of Stock:
  • 3.1. All customer orders not fulfilled immediately will be back-ordered. Deliveries are subject to factory stock availability, manufacturing lead time and shipping estimate time. BOSE SAUNA is not liable for charges due to unavailability.
  • 3.2. BOSE SAUNA will be released from all obligations and liability in events beyond its control (e.g., shipment delays, factory delays, natural disasters or the like etc).
  • 3.3. Variation: BOSE SAUNA can vary the terms & conditions at any time without notice.
  • 3.4. Prices & Payments:
  • 3.5 Deposit: A 50% minimum deposit is required when placing an order; the balance is to be paid by the customer before delivery.
  • 3.6. BOSE SAUNA has the sole discretion to change the price of its Goods and Services at any time before the Client places an order for Goods or Services, whether or not BOSE SAUNA has previously provided a Quote. 3.7. BOSE SAUNA reserves the right to change the price of Goods and Services, subject to variations being made to the order by the Client. 3.8. All payments are to be made in $AUD Australian Dollars. 3.9. BOSE SAUNA will only accept payment by cash, direct bank deposit. A surcharge of 2.5% will be applicable on all payments by way of electronic transaction paid by credit card. 4.0. Receipt by BOSE SAUNA of any form of payment other than cash shall not be deemed to have been paid until the payment has been cleared into BOSE SAUNA’s bank account.
  • 4.1. BOSE SAUNA reserves the right to suspend provision and/or delivery of the Goods until payment of the purchase price is made in full, including any other amount payable under these Terms. 4.2. The title of the Goods does not pass until full payment is made to BOSE SAUNA. If the customer defaults on the payment terms, the Client grants to BOSE SAUNA the right to exercise its right of retaking possession of the said Goods, then the Client agrees to indemnify BOSE SAUNA for any loss or damage as a result of any such retaking possession of the said Goods.
  • 4.3. Balance: Full payment is due before goods are dispatched or picked up. Ownership remains with BOSE SAUNA until full payment.
  • 4.4. Non-payment: If the customer does not pay the outstanding balance, BOSE SAUNA can suspend supply, cancel the order, and charge daily/weekly storage fees if the item/s are held at BOSE SAUNA premises for more than 30 days past the initial delivery date.
  • 4.5. If a pre-ordered item is delayed, we will notify the customer with an estimated shipping arrival date.
  • 4.6. All products are subject to availability when the order is placed.
  • 4.7. Limitations of Liability: BOSE Sauna is not responsible for any errors, omissions, or misprints regarding product pricing or availability. We reserve the right to change prices, modify product specifications, or discontinue models and promotions at our sole discretion.
  • 4.8. Debt Recovery: The customer is liable for all expenses and legal costs incurred by BOSE SAUNA to recover unpaid monies.
  • 4.9. Immediate Payment: All outstanding sums become immediately due if the customer defaults on payment, becomes bankrupt, or has a judgment entered against the customer.
  • 5.0. Pricing: Prices are based on the time of enquiry. BOSE SAUNA reserves the right to increase prices, but will not change prices for accepted existing orders. Quotations are valid for 30 days.
  • 5.1. Accuracy: The customer is responsible for ensuring the accuracy of all specifications in a quotation.
  • 5.2. Custom Orders: Require a non-refundable 50% deposit payment. The customer cannot cancel a custom-made order; BOSE SAUNA retains the full payment.
  • 5.3. Exclusions: Our prices do not include insurance, special packing, or delivery costs unless otherwise stated.
  • 5.4. Our prices include 10% GST.
  • 6.0. Delivery of Goods: 6.1. The Client must specify on the purchase order, or otherwise in writing, if Goods are to be delivered to the Client’s address or if the Client will collect the goods from our warehouse, or if the Client will organise a freight delivery service. Note: Delivery charges will apply to all orders unless the customer picks up the order from our warehouse. 6.2. Any period or date for delivery stated by BOSE SAUNA is intended as an estimate only and is not a contractual commitment. BOSE SAUNA will use its best endeavours to meet any estimated delivery dates. BOSE SAUNA will not be liable for any loss or damage suffered by the Client or any other person for failure to meet an estimated delivery date, failure to deliver the Goods the client ordered or delay in delivery of the Goods, including consequential damages. 6.3. If the Client brings a claim against BOSE SAUNA for the late delivery of Goods, then the Client shall be liable in full for any legal fees, charges, or expenses that BOSE SAUNA may incur as a result of the Client initiating any legal action against BOSE SAUNA, its representatives or agents, to be calculated on a solicitor-client basis. 6.4. Delivery of the Goods is taken to have occurred at the time that the Client or the Client’s nominated carrier takes possession of the Goods. If BOSE SAUNA or its nominated carrier delivers the Goods, then delivery is taken to have occurred at the date & time that the Goods are delivered to the Client’s nominated address, even if the Client is not present at the address. 6.5. The Client must take delivery by receipt or collection of the Goods whenever they are tendered for delivery. If the Client is unable to take delivery of the Goods as arranged, then BOSA SAUNA shall be entitled to charge its full costs for re-delivery and/or storage. 6.6. Delay in the delivery of Goods shall not entitle the Client to any refund or discount of the purchase price, nor shall it relieve the Client of its obligation to accept and make full and final payment for the Goods by the due date. 6.7. Any Client collection of Goods is at Client’s own risk and responsibility. 6.8. BOSE SAUNA may deliver the Goods in separate instalments if it deems it necessary. Each separate instalment shall be invoiced and paid for by the provisions in these Terms, including delivery fees. 6.9. BOSE SAUNA use private transport companies for all deliveries. Delivery charges vary in cost per pallet; this depends on the time (date, month) of the year, quantity supplied, weight, volume & size of the item and if supplied with or without a fork on the truck for unloading.
  • 7.0. Delivery of the Goods to a third party nominated by the Client is deemed to be delivery to the Client for the agreement. 7.1. The Client is responsible for signing for all Goods received. If the Client is in attendance at the time of delivery, then they must sign a BOSE SAUNA delivery note confirming receipt of the Goods, and if the client is not in attendance on site, it is then the client’s responsibility and risk of the goods delivered, and left on site. 7.2. This clause applies to BOSE SAUNA clients, where the transport company that is contracted by BOSE SAUNA delivers goods to the client’s site address. If there is any time delay at the delivery site due to the client not accepting the delivery when transport arrives to unload the goods at the client’s site address, the return transport fee will apply to the customer. The transport waiting time for the customer to arrive on site is 10-15 minutes. After this period of time, the goods will be returned to our warehouse.
  • Delivery Areas: BOSE SAUNA delivers Australia-wide. Please email us your address and postcode so that we can confirm if we can deliver to your address with a delivery quotation.
  • Delays: BOSE SAUNA is not liable for delivery delays; quoted shipment arrival dates are estimates only.
    Freight Charges:
  • These are indicative only; the customer will be responsible for any additional freight charges outside the agreed-upon standard delivery.
  • Cancellations/Changes to Delivery: Changes or cancellations made less than 3 business days from delivery will incur a restocking fee of a minimum of 20% of the tax invoice, and also be liable for any cancellation of the booking transport delivery cost.
  • Acceptance: The customer is deemed to accept delivery when goods are delivered or made available for collection.
  • Inability to Accept Delivery: If the customer does not accept delivery, BOSE SAUNA will store the goods, and the customer will be liable for all associated costs (warehousing, insurance products cost, transport, and administrative costs).
  • Payments: The customer must make any outstanding invoiced payments before delivery of goods.
    15. Building and Construction Industry Security of Payment Act 2002: 15.1. At BOSE SAUNA’s sole discretion, if there are any disputes or claims for unpaid Goods and/or Services, then the provisions of the Building and Construction Industry Security of Payment Act 2002 (Vic) (“the Act”) may apply. 15.2. Nothing in this agreement is intended to have the effect of contracting out of any applicable provisions of the Act, except to the extent permitted by the Act where applicable.
    Returns, Damages or Loss in Transit:
  • Authorisation: The customer must get prior authorisation and approval from the BOSE Sauna office to return any goods.
    Damage Notification: The customer must notify BOSE SAUNA and the freight carrier of any damage (internal or external) within 24 hours of receiving the goods. Claims made after this period will not be accepted.
  • 8.0. The provisions set out in this clause 9 are limited and subject to the extent of any limitation on BOSE SAUNA’s liability as set out in these Terms. 8.1. All claims for defective Goods will be addressed and concluded under any/all current Australian standards applicable at the time. All returns of Goods are to be approved in writing by BOSE SAUNA office before any Goods are returned. BOSE SAUNA reserves the right and discretion to not accept the return of any/ all Goods purchased by the Client. 8.2. The Client is liable for any freight costs associated with returning any Goods to BOSE SAUNA warehouse. BOSE SAUNA will not refund the cost of any freight charges incurred for delivery. 8.3. No claim(s) will be accepted once the products are fixed and/or laid. 8.4. No Goods will be credited unless returned in strict original good order, including packaging boxes (dirt-free, not wet, boxes in original good packed) and re-saleable condition within 30 days from the date of invoice unless arranged and authorised by BOSE SAUNA. Custom-made or factory orders will not be refunded. 8.5. No claims for breakage and shortage will be accepted unless notification is received at the time of delivery or within 24 hours from delivery. 8.6. The Client must provide proof of purchase on all returned Goods, including an invoice number. 8.7. If BOSE SAUNA accepts returned Goods from a Client, then BOSE SAUNA may provide a Client with a credit note only for the general product purchase orders. The method of credit provided to the Client is at the discretion of BOSE SAUNA office. No credit note or refund will be provided to the client under any circumstances for custom-made, special product order/s, or if the product cannot be resold. 8.8. BOSE SAUNA may, in its absolute discretion, accept non-defective Goods to be returned, in which case BOSE SAUNA will require the Client to pay handling fees of a minimum 20% of the total tax invoice, including GST of the returned Goods, plus any freight costs. 8.9. Notwithstanding anything contained in this clause, if BOSE SAUNA is required by a law to accept a return, then BOSE SAUNA will only accept a return on the conditions imposed by the law.
  • 9.0. All returned goods must be in original packaging and in good, resaleable condition. The return of goods is at BOSE SAUNA company’s discretion only, whether to accept or reject the return of any goods. 9.1. All credits and returns are at BOSE SAUNA’s sole discretion.
  • Cancellations are not accepted unless BOSE SAUNA approves and consents in writing, and the customer pays a cancellation charge. Cancellations are strictly not accepted for custom-made products, non-standard stock in manufacturing or ready for shipment.
  • Complaints: Must be submitted in writing within 5 business days of delivery for lost, incomplete, or damaged goods. Otherwise, the customer is deemed to have accepted the goods.
  • Freight Damage: Before signing for pickup/delivery, check for shortages or visible outer packaging damage and endorse the consignment note accordingly.
  • No Liability: BOSE SAUNA is not liable for indirect, incidental, or consequential damages from installation. (eg, Damage to structures).
  • Return of standard stock models only (30-Day Customer Satisfaction Guarantee from receipt of goods date):
    Return of Goods Eligibility:
  • The customer is to provide a copy of the paid original invoice, with the date showing.
  • No returns after 30 days from the delivery date.
  • Goods must be returned in original packaging, and the customer is responsible for damage during return shipment.
  • Accepted returns incur a minimum 20% re-warehousing handling fee, with all freight costs and risk remaining the customer’s responsibility.
  • The items purchased must be in “as new condition” (no scratches, odours, marks, etc.).
  • The items must be in the same working order as received.
  • The items require full inspection and approval by BOSE SAUNA office staff before a refund.
  • The customer must notify our office in writing with copies of the invoice and send it to: info@bosesauna.com.au.
  • Freight Charges: The customer must pay freight charges for all returned goods.
    Limitation of Liability:
  • BOSE Sauna cannot and will not accept responsibility for delivery failures or delays by our third-party contractor.
  • Total Liability: Limited to the lesser of $100.00 or the cost of rectifying the goods supplied only.
  • No Liability for Indirect/Consequential Damages: BOSE SAUNA is not liable for indirect, special, incidental, or consequential damages from delivery & installation.
  • Local Council or Building Regulations: BOSE SAUNA is not responsible or liable for advice on local council regulations (e.g., building approval of sauna and spa, swimming pool spa use consents). Any information provided is general. The customer is to check with your local council & building construction regulations requirements.
  • The customer is fully responsible for organising registered electricians, plumbers and any other tradesperson to construct, install any purchased items from BOSE SAUNA.
    Warranty:
  • Non-transferable: The warranty is not transferable.
  • Australian Consumer Law: BOSE SAUNA liability may include repair, replacement, or refund, depending on the nature of the fault (minor or major).
  • Return Costs: If goods are returned to BOSE SAUNA warehouse under warranty, the customer is responsible for the return transport cost, and the costs relating to the removal of the sauna or product/s from its premises.
  • This Limited Warranty does not cover damage resulting from: Negligence by the user or any third party; Installation in wet or high-humidity areas (e.g., bathrooms or outdoors); Any modifications, including those intended to meet local codes; Improper installation, including failure to follow the instructions and specifications provided with the unit; Connections made by the installer, an electrician, or any third party; Incorrect voltage supply or unauthorised electrical modifications; Misuse, abuse, improper use, or incorrect operation; Failure to perform routine or preventive maintenance; Unauthorized repairs performed by a third party; Normal wear and tear.

  • Responsibility: 

    Unless otherwise expressly agreed in writing:
    (a) All installers are independently contracted by the user and are not under the direction or control of BOSE Sauna;
    (b) The installer is the user’s responsibility; and
    (c) BOSE Sauna assumes no obligation, liability, or responsibility in connection with the installer.

    The installer is responsible for inspecting the unit prior to installation to ensure it is free from defects or damage. Notices on and in the unit, as well as on the shipping carton, inform the installer of this responsibility. If any issues are identified before installation, the unit must not be installed. BOSE Sauna is not responsible for failures or damage that could have been detected, repaired, or prevented through reasonable inspection before installation.

  • Assumption of Risk: Users of BOSE Sauna products assume all risk and liability for the outcomes resulting from their use, including operating costs, overall effectiveness, health results, or success/failure. This applies regardless of any oral or written statements, technical advice, or other guidance provided by BOSE Sauna related to the use of its products.
  • Qualified Tradesperson: All electrical and plumbing work must be undertaken by a qualified, registered tradesperson.
    10.0. Passing of goods, retentions of title and Personal Properties Securities Act: 10.1. The Client agrees that until full payment of all monies owing to BOSE SAUNA, the Goods remain the property of BOSE SAUNA, and no property in or title to the Goods will pass to the Client. 10.2. The Client shall not remove from the Goods any documentation affixed to the Goods until title to the Goods has passed to the Client under clause 12 of these Terms. 10.3. Failure to make payment by the due date, without prejudice to any other available remedies, entitles BOSE SAUNA to repossess the Goods from any premises where they may be and resell all or any of the Goods. To repossess the Goods, the Client hereby grants an irrevocable licence to BOSE SAUNA, its employees, agents or contractors any time or day of week to enter upon such premises as BOSE SAUNA reasonably suspects the Goods may be located, using such reasonable force as is necessary and the Client will indemnify BOSE SAUNA from and against any liability to any third party in respect of any such damage and from and against all actions, proceedings, claims, demands, costs, damages and expenses howsoever arising. 10.4. Notwithstanding the foregoing, BOSE SAUNA will be entitled to bring an action against the Client for the price of the Goods in the event of non-payment by the Client by the due date as if the property in the Goods had already passed to the Client. 10.5 The Client agrees that these Terms constitute a security agreement for section 20 of the Personal Properties Securities Act 2009 (Cth) (‘PPSA’) and that a security interest exists in all Goods and Services to be provided and or supplied by BOSE SAUNA (and their proceeds) and all future Goods and Services (and their proceeds). The Client agrees and undertakes to do anything that BOSE SAUNA requires (such as obtaining consents and signing and procuring documents) in connection with the registration of this document or any other document on any register established according to the PPSA. 10.6. At your request, you appoint us as your agent to undertake transactions on the PPSR on your behalf, including registering one or more Financing Statements with security interest(s) provided for by documents we have prepared or reviewed for you. We undertake such transactions based on the terms, conditions and limitations of liability set out in these Terms, the Cost Agreement or as otherwise agreed in writing. By requesting us to undertake such transactions, you accept and agree to us acting on this basis. If you do not wish us to proceed (or continue) on this basis, please let us know, and we can discuss alternative arrangements with the customer.
  • The user or customer/installer must open the crate and inspect the unit for damage upon delivery. Any damage must be reported immediately, in writing, to both BOSE Sauna and the carrier, and an inspection must be requested. Damage occurring during installation is the responsibility of the installer and/or building contractor, while damage occurring afterwards is the responsibility of the customer/user.

    The installer is responsible for understanding local building code requirements and for installing the unit safely in accordance with all applicable regulations. BOSE Sauna is not responsible for any costs associated with modifying the product to meet building code approvals, including municipal, state, or Australian building codes.

  • Acrylic spas, bath & pool shell structure is guaranteed for 5 years from the delivery date. The installation must be undertaken in accordance with the manufacturer’s specification manual.
  • Sauna, spa, pools and all other units are intended for personal residential use. There is no warranty for sauna units & spas, pools that are used for commercial purposes.
  • All freight costs for parts under warranty are the customer’s responsibility.
  • The warranty for the sauna heaters is 5 years.
  • All under warranty items, the labour cost to remove and replace any item/s in the sauna or spas or other, including heaters, is the customer’s responsibility.
  • All spa jets have a 5-year warranty from the date of delivery. The installation of the units must be in accordance with the manufacturer’s instructions; heating elements are not covered under this warranty against corrosion.
  • Spa & pool heat pumps, filtration cartridges, motors and control systems have a 5-year warranty from the date of delivery, provided that the use of the items is by the manufacturer’s instructions.
  • Warranty is excluded if the unit is installed incorrectly, misused, inappropriate chemicals are used, does not cover filters, or the customer fails to maintain the product according to the manufacturer’s instructions.
  • All sauna components (ie: digital system control, temperature control, wiring & power supply, seating in sauna, lighting, audio system etc) have a 1-year warranty.
  • All spa & swimming pool components (ie: digital system control, circulation system, pipes & plumbing, water heater, temperature sensor, filter, ozonator, sanitiser, digital control panels, wiring & power supply, air blower system, external cover, lighting, audio system etc) have a 1-year warranty.
  • Ice+hot tub has a 2-year warranty.
  • Chiller generators have a 2-year warranty.
  • Limited Warranty: on the indoor & outdoor sauna structure is 5 years from the date of delivery. The timber discolouration is not included in the warranty.
  • The ice tub + hot tub – Stainless Steel structure is warranted for 2 years from the date of delivery; surface rust on stainless steel is not included in the warranty.
  • It is the owner’s responsibility to undertake regular inspections of all products and ensure maintenance is performed regularly.
  • Sauna structure has 5 years warranty, heaters have a 5 years warranty, accessories do not have any warranty, spa structure has 5 years warranty, spa – swimming jets has 5 years warranty, and generator for spa water heater have a 2 year warranty (the warranty covers replacement of parts or product warranty only and does not include labour or tradesman removal + installation costs and transport or freight costs).7. Commercial use refers to any application that is not residential (businesses, schools, hospitals etc) Warranty Conditions Defect in the goods caused by improper use, improper installation & failure to observe manufacturers installation instructions, surface damage caused by installation, installation by a non-licensed plumber, products not installed to relevant National Standards and State Regulations, improper care of goods, unusual physical or environmental conditions, use in an application for which the product was not intended or designed, harsh detergents or abrasive cleaners and products used in a commercial application will not be covered by the warranty. Other exclusions to the warranty include: heater units, panel heating, Generators, Valves • waterjet fittings and washers • filters • Normal wear & tear AS/NZS 3500.
  • 11.1. Any warranty BOSE SAUNA provides does not cover against timber or acrylic fading, variations in colour, or texture, as these are characteristics of the Goods. 11.2. All Goods purchased including heaters, sauna units, accessories, spa, pools and or any other product including in the purchase order by the client & or tax invoice to the client must be inspected, checked and verified by the Client to ensure that the Goods are what the Client purchased and ordered and selected including the Goods’ size, finish, capacity. BOSE SAUNA will not be liable for any claim made by the Client if the wrong Goods are delivered to the Client. If the product item/s that are fixed or installed by the Client, then no claim or liability will be admitted by BOSE SAUNA. 11.3. BOSE SAUNA shall not be liable to the Client or any third party for loss or damage, including indirect, special, incidental or consequential loss or damage, however caused, which may arise out of failure or omission on the part BOSE SAUNA, except as is allowed by any applicable legislation. 11.4. Although BOSE SAUNA  will endeavour to advise Clients, BOSE SAUNA reserves the right to make any changes at any time to information about Goods and Services before purchase, without notice to the Client. BOSE SAUNA reserves the right to discontinue Goods from sale, change prices, or change ranges before purchase, without notice to the Client. BOSE SAUNA will not be held liable for any costs to the Client or any other parties as a result of any such changes being made. 11.5. SHIPPING & FACTORY LEAD TIME: If BOSE SAUNA is out of stock on an item(s) or a range of Goods, it will endeavour to notify the Client by writing, email and or verbally with the available information and lead time as to when this information is available. Lead times are approximate only. BOSE SAUNA is not liable in any way and will not be held liable for any loss or damage suffered by the Client due to a shortage of Goods. 11.6. The Client acknowledges that variations of the acrylic & timber surface colour, unit size, timber thickness, shade, and grain timber knots are nominal & characteristic of the timber in all BOSE SAUNA Goods. BOSE SAUNA will not be liable for any loss, damage or costs howsoever arising resulting from any colour variation, nominal size, or thickness of the final product supplied, and strictly once the products have been fixed. Further, the Client acknowledges that all Goods are sold subject to their normal and natural colour variations, size & thickness. 11.7. The material contained on BOSE SAUNA website is only a guide without warranty. BOSE SAUNA accepts no liability for any errors in the content of the information provided on its website and any loss or damage arising out of the use of the BOSE SAUNA Goods and services or promotional material. All products are to be used according to the directions of use on the label of the product(s). Product images and details on the website are as accurate as possible. Colour and representation of images on the website may vary from the actual product.
  • 12.0. The following conditions will apply: 1. Documentary proof of purchase must be provided. 2. The guarantee expires on the anniversary of the purchase date. 3. Goods are to be used only for the purpose they are designed for use. 4. Installation instructions must be followed. 5. Warranty extends to products purchased in Australia only. 6. The guarantee is limited to the original purchaser and is non-transferable. 12.1. The following conditions will not apply: 1. Damage caused by normal wear and tear, accidents, negligence, alteration, use of abrasive cleaners or misuse. 2. Damage to returned goods while under the care of the customer or the customer’s agent. 3. Labour costs not expressly authorised by BOSE SAUNA in writing, including cost of installation, uninstallation, consultants’ cost or technical advisors. 4. Damage caused by unauthorised repairs or the use of non-standard spares. 5. Damage caused by impurities in pipes, including hard water. 6. Possible imperfections which are part of the characteristics of the materials. 7. Claims for consequential damage and liquidated damage. 12.3. The warranty shall be the warranty provided by the manufacturer/s of the Goods only and under the manufacture/s country standards and quality management systems and their country’s relevant standards. 12.4. The Client must inspect all Goods before installation. If the Goods provided by BOSE SAUNA have defects, or the wrong quantity has been provided, then BOSE SAUNA will not be liable for any such defects if the Goods were installed before the Client noticed any such defect. 12.5. BOSE SAUNA warranty does not cover damage caused by structural movement, normal wear and tear, damage or defects caused by incorrect installation, lack of proper maintenance, accidents, abuse or misuse. It is the Client’s responsibility to satisfactorily demonstrate that the substrate material and fixatives are suitable for the purpose. BOSE SAUNA reserves the right to determine if the fault is a non-valid defect. 12.6. Any Goods provided by BOSE SAUNA, including sauna, spa, swimming pools, or other products, must be fixed in accordance with the relevant authorise, fixative manufacturer’s instructions, applicable building laws and regulations, building codes and Australian Standards. BOSE SAUNA is not liable for any failure of the fixing of the Goods where the application of any of the structural material, fixative or fixing is not adhered to in accordance with relevant authorities and the manufacturer’s instructions & applicable building laws and regulations, building codes and Australian Standards, including. In addition, BOSE SAUNA will not be liable in any way where the Client cannot satisfactorily demonstrate that the structural material and fixatives are/were suitable for the purpose. 12.7. BOSE SAUNA shall not be bound by nor be responsible for any term, condition, representation or warranty other than that which is given by the manufacturer of the Goods. 12.8. The Client must inspect the Goods on delivery and must notify BOSE SAUNA immediately on the day of delivery in writing of any evident defect/damage, shortage in quantity or failure to comply with the description, purchase order, invoice or quote. 12.9. The Client must notify BOSE SAUNA of any other alleged defect in the Goods on the same day or at the start of installation or as soon as possible after such defect becomes evident to the client or installer of the product. Upon such notification, the Client must allow BOSE SAUNA to inspect the Goods. If the Client fails to comply with these Terms, then the Goods and Services provided by BOSE SAUNA shall be presumed to be free from any defect or damage.
  • 13.0. BOSE SAUNA acknowledges that nothing in these Terms purports to modify or exclude any non-excluded guarantees that may be implied by law. 13.1. Except as expressly set out in these Terms or concerning the non-excluded guarantees, BOSE SAUNA makes no warranties or other representations under these Terms, including but not limited to the quality or suitability of the Goods. 13.2. BOSE SAUNA’s liability in respect of these warranties is limited to the fullest extent permitted by law. If BOSE SAUNA is required to replace the Goods under this clause or the Competition and Consumer Act, but is unable to do so, BOSE SAUNA may refund any money the Client has paid for the Goods. 13.3. If the Client is not a consumer within the meaning of the Competition and Consumer Act, BOSE SAUNA’s liability for any defect or damage in the Goods is: a. Limited to the value of any express warranty provided to the Client by BOSE SAUNA; b. Limited to any warranty to which BOSE SAUNA is entitled, if BOSE SAUNA did not manufacture the Goods; and c. Otherwise negated absolutely. 13.4. BOSE SAUNA shall not be liable for any defect or damage which may be caused by or arise as a result of: a. the Client failing to properly maintain or store any Goods; b. the Client using the Goods for any purpose other than that for which they were designed; c. the Client continuing the use of any Goods after any defect became apparent or should have become apparent to a reasonably prudent operator or user; d. the Client failing to follow any instructions or guidelines provided by BOSE SAUNA; e. Fair wear and tear; f. Any accident, and g. Act of God.
  • 14.0. Indemnity & limitation of liability: 14.1. To the extent permitted by law, BOSE SAUNA will not be liable to the Client or any other person under any circumstances for any damage, loss of use, profit, revenue or for any injury or death to any person, or for any indirect, incidental or consequential damages sustained or incurred by the Client, including if such liability arises directly or indirectly as a result of: a. Any negligent act or omission or wilful misconduct of BOSE SAUNA or its employees or agents; b. The supply, installation, performance or use of any Goods; c. Any delays in supplying the Goods; and d. Any act of God, terrorism, strike, lockout, industrial action, fire, flood, storm or other event beyond BOSE SAUNA’s reasonable control. 14.2. The Client will indemnify BOSE SAUNA from and against any loss, damages, legal costs and expenses arising from any claim, demand, action by any person or company, corporation, where such liability is in respect of any breach of this agreement by the Client or BOSE SAUNA. If any part of this agreement or Terms is found to be void, unenforceable, or unlawful, then that part will be deemed severable from this agreement. 14.3. BOSE SAUNA’s liability for any breach of any term or condition set out in these Terms shall be limited to: a. A refund of the purchase price. b. The replacement of the Goods or the supply of equivalent Goods, or c. The payment of the cost of replacing the Goods or acquiring equivalent Goods. 14.4. No claims or liability shall be accepted by BOSE SAUNA in respect of: a. performance of the sauna heater or sauna unit, performance of the spa & swimming pool jets, timber fading, variations in shade/colour/texture, surface finish, which might be an inherent characteristic of the Goods or the factory-made variation in finish. b. Any maintenance, care or installation of the Goods by the Client. d. Goods not in perfect condition, in opened boxes, wet boxes or which are damaged in any way. 14.5. Any claims, complaints or notification of missing or damaged Goods must be made to BOSE SAUNA within 24 hours of delivery or supply of Goods and before the Goods are installed and/or fixed. The Client shall be deemed to have accepted the Goods and to have waived any rights if no claim, complaint or notification action is made at the time of delivery. Any claim, complaint, or notified action made outside this time, or after the Goods have been fixed and or installed, shall not be accepted.
  • 15.0. Default: 15.1. Interest on all overdue amounts shall accrue daily from the date when payment becomes due until the date of payment at a rate of 14.50% per annum. For the avoidance of doubt, overdue amounts include amounts specified in a quote, purchase order, invoice, product insurance, Warehousing Fees and any other penalty fee or amount charged by or due to BOSE SAUNA from time to time. 15.2. If the Client owes BOSE SAUNA any money, or defaults on payment, then the Client shall indemnify BOSE SAUNA from and against all costs and disbursements incurred by BOSE SAUNA in recovering the debt, including but not limited to internal administration fees, legal costs on a solicitor and own Client basis, collection agency costs, and bank dishonour fees. 15.3. BOSE SAUNA reserves the right to suspend or terminate the supply of Goods to the Client if the Client fails to comply with an obligation under these Terms. BOSE SAUNA will not be liable to the Client for any loss or damage the Client suffers because BOSE SAUNA has exercised its rights under this clause.
  • 16.0. Product maintenance: 16.1. BOSE SAUNA recommends cleaning all products with warm, soapy water. Acidic or highly alkaline cleaners should never be used. Cleaning of all Goods should only be in accordance with the manufacturer’s specifications. 16.2. Before installation of any Goods, the Client should ensure that the appropriate Amps electrical capacity is installed and suitable for use in accordance with the manufacturer’s specifications. 16.3. Ongoing maintenance: BOSE SAUNA recommends avoiding cleaners that contain abrasive chemicals, which can damage the Goods. The Client should always refer to the manufacturer’s Goods specification. BOSE SAUNA recommends a soft sponge with clean, warm, soapy water to clean the surface of all products. 16.4. Regular cleaning and maintenance must be strictly adhered to in accordance with the manufacturer’s warranty and recommendations.
  • 17.0. Risk: 17.1. Risk of damage to or loss of the Goods passes to the Client upon delivery. If any of the Goods are damaged or destroyed following delivery but before ownership passes to the Client, then BOSE SAUNA is entitled to receive all insurance proceeds payable for the Goods. The production of these Terms by BOSE SAUNA is sufficient evidence of BOSE SAUNA’s rights to receive the insurance proceeds without the need for any person dealing with BOSE SAUNA to make further enquiries. 17.2. If the Client requests BOSE SAUNA to leave Goods outside BOSE SAUNA’s premises for collection or to deliver the Goods to an unattended location, then such Goods shall be left at the Client’s risk, with no liability for lost, stolen or damaged Goods accepted by BOSE SAUNA.
  • BOSE SAUNA reserves the right to request the return of the component, items to BOSE SAUNA warehouse for assessment before it is replaced or repaired. If the component is deemed to be defective. The customer will be reimbursed.
  • Jet Warranty: The warranty does not cover damage to heaters or pumps caused by incorrect water balance, resulting in the heater or pumps being subjected to abrasive/ acidic water.
  • This warranty excludes Jet damage by grit, sand and improper water chemistry causing corrosion of the part and is limited to the supply of replacement parts after the faulty part has been returned to BOSE SAUNA for warranty inspection. Leaking from jets is covered by the plumbing warranty. BOSE SAUNA jets have a 1-year parts-only warranty.
  • Spa & Swimming pool warranty: 
  • The swimming pool & spa is warranted for acrylic sheet leakage for 5 years.
  • The acrylic shell is warranted against cracking of the interior or exterior surface for 5 years.
  • The electrical equipment components, including pumps, water heater, and digital control system, have a warranty for defects is for 2 years.
  • Plumbing components against leaks, defects in material, and warranty are for 2 years.
  • Warranty for all other components, including but not limited to: surface finish, filters, ozone system, UV sanitiser, audio system, headrest, and mats. All other factory-installed components not mentioned, including but not limited to: jets, valves, LED lighting, mechanical components, and accessories. lighting, water suction, water heater, and all pumps.
  • This limited warranty is void if BOSE SAuna (manufacturer) determines that the spa, swimming pool has been subject to damage or failure due to the installation of generic parts or non-genuine parts and products. The disclaimer includes, and is not limited to, filters, lights, ozone system, etc.
  • During the BOSE Sauna Warranty Period: (a) the sauna cabin will retain its structural integrity; and (b) all factory-installed components, including heater controls, power supply, electrical wiring, and any built-in audio system, will be free from defects in materials and workmanship.
  • Bose Sauna reserves the right to request proof that the sauna was installed by a qualified electrician.
  • Limitations: This warranty does not cover defects or damage due to normal wear and tear, improper installation, alteration without BOSE SAUNA prior written consent, misuse, abuse, commercial or industrial use, use of an accessory not approved by BOSE SAUNA, failing to follow delivery Instructions or the Owner’s Manual, or repairs made by anyone unauthorised. BOSE SAUNA will not be liable for costs associated with, but not limited to, building alterations, removal costs, delivery costs or labour costs associated with the replacement of the purchased item.

Warranty exclusions: 1. Damage resulting from improper water maintenance. 2. Damage from operating the spa above 43°C. 3. Damage caused by clogged filters. 4. Damage caused by not installing the spa on a hard level surface. 5. Damage caused by incorrect electrical installation. 6. Warranty is not extended to filter cartridges, head rests, pump seals or drain hoses. 7. Commercial use. 8. Damage caused by the relocation of the spa from its originally installed location. 9. Damage by termites or other pests. 10. Damage caused by flooding. 11. Damage or corrosion, Rust or Corrosion caused by being close to seawater, rivers or oceans.

  • 18.0. Sauna Use Caution:
  • Recommended limit sessions to 30–40 minutes, or as per your doctor’s advice.
  • Stay hydrated before and after use.
  • Exit immediately if you feel dizzy, lightheaded, or unwell.
  • Do not use if under the influence of alcohol, drugs, or while ill.
  • Consult a doctor before use if you have heart conditions, high blood pressure, or are pregnant.
  • Children should use the sauna only under adult supervision and for shorter durations.
    19.0. Intellectual property: 19.1. Where BOSE SAUNA has designed and developed Goods and/or Services for the Client, then the copyright in any designs, drawings and documents or Goods created by BOSE SAUNA shall remain the property of BOSE SAUNA. BOSE SAUNA, at its sole discretion, can use it if it wants to use it, for, and not limited to, advertising, marketing or entry into any competition, any of the designs, documents so produced. 19.2. The Client warrants that all designs, specifications, instructions given to BOSE SAUNA will not cause BOSE SAUNA to infringe any patent, registered design or trademark in the execution of the Client’s order, and the Client agrees to indemnify BOSE SAUNA against any action taken by a third party against BOSE SAUNA in respect of any such infringement.
